Update 5/20/16 10 a.m.- The alleged offending mashgiach is Rabbi Naftali Maklev (נפתלי מקלב). His brother, Uri Maklev, was a member of Knesset for Degel Hatorah, the party directed by Rabbis Steinman and Kanievsky, the leaders of the main Yeshivish Lithuanian ultra orthodox faction in Israel. The full indictment, in Hebrew, can be read on Nuchem Rosenberg’s blog. (you will have to page down through multiple windows to get there). I have changed the posting title to include his name. As reported earlier, he does indeed have a child married to the grandchild of Rabbi Chaim Kanievsky. He is/was a mashgiach ruchani (spiritual advisor) at Yeshivat Ba’er Hatorah’s Bayit Vegan branch on Rechov Hapisgah in Jerusalem.

Update 5/20/16, 7 p.m.– The lower grade (ketanah) yeshiva where Maklev worked is locally known as GIL the Hebrew acronym of the yeshiva head, Gavriel Yosef Levi. Rabbi Aron Feldman, the Head of Ner Israel Rabbinical College in Baltimore is the father-in-law of Rabbi Levi (aka GIL) Rabbi Levi has many enemies because of his sharp elbows and ruthlessness in his rise as well as using the influence of his prestigious father-in-law. So there is some schadenfreude piling on going on by his enemies. Equally, R. Kanievsky’ enemies in the Shmuel Auerbach camp are also piling on to discredit R. Kanievsky. To be clear, while there are important family and influence connections between RCK and the defendant, there is nothing reported so far implicating him in either the evil deeds or a cover-up. In fact, the prosecution praised some influential rabbis who aided the prosecution. Who they are yet is not clear, but it appears that there was a Beit Din (rabbinical court case) in the court of R. Karelitz in Bnai Brak. Available information suggests the court supported reporting, but that is not yet confirmed.

 UPDATE 5/20/16 7 a.m.– The Hebrew language website, Kikar HaShabbat reports that the alleged offender’s recorded lectures were removed from the the website, Kol Halashon.

Jerusalem prosecutors filed an indictment against a rabbi who served as a mashgiach [spiritual advisor] at a yeshiva in the city, for a series of rapes carried against a number of female relatives over the course of several years.

The accused began his horrific campaign of abuse when his first victim was just six years old, and continued abusing her and other female relatives by various means of coercion and manipulation……

He had attempted to justify his actions by perversely claiming they were not only permitted under Jewish law, but mandated. In some cases he even went as far as to claim his acts of abuse served to “purify” his victims spiritually and atone for sins their souls committed in “past lives”, or to cure them of physical ailments.

In one particularly extreme incident relayed in the indictment, the accused secretly recorded leading haredi Rabbi Chaim Kaniyevsky issuing a halakhic ruling on a totally unrelated subject, then played it back … and claimed the rabbi was in fact endorsing the abuser’s actions, in order to persuade her against speaking out.

According to one report which I am not yet able to confirm, the alleged offender’s daughter is married to the grandson of Rabbi Chaim Kanievsky, the effective leader of most of the Litivsh/Yeshivish world.

  1. BLI SAFEK this does not sound like a “maybe” case,
    He should be sliced over, and after that,
    life imprisonment with no chance of “lightenng”
    makel, zero chance.
    This evils SOB belongs in Gehennom,
    no capital punishment unfortunately as far as I know,,
    let justice me meted out in the jail cell,.
    But not before he does total mechilah in public for his victims,
    I hope he has no DNA following him.
    Just for clarification “mashgiach” is not only for food?? but also for ruchaniut???
    May he rot, yes, and others will get upset by this usage, , but sorry, YSZ, and worse if it were possible,

  2. Yerachmiel, maybe it’s the late hour, but I’m confused by the wording in this paragraph – would mind expounding on it?

    I sort of get it, but I’m missing a part. What I keep re-reading is the accused secretly recorded Rav Kaniyevsky’s ruling on a totally different topic. Here is where I’m confused “then played it back to the accused…” Isn’t the accused the abuser?

    • You are right. I did copy the original article correctly but they got it wrong. Obviously they meant the victim. I have dropped those few words from my posting to eliminate the confusion.

  3. This story is actually a hopeful development. The local Rabbi’s were informed of the case by another family member and despite the accused “high standing” reported the case to the police.

    This seems to indicate that even the mainstream Charedi institution is no longer trying to “treat” abuse on there own and is handing such cases over to the state

  4. the secular press has standards about not reporting the names of the victims. would suggest just saying that fellow is accused of abusing “relatives,” rather than specifying who those relatives are.

  7. Obviously, the accused’s mere family relationship (by marriage) to Rabbi Kanievsky casts no blame on Rabbi Kanievsky. At the moment, I must assume he knew nothing of these allegations until the rest of us did — and he may well support a full and fair prosecution of the charges. I will be among the first to applaud him if that turns out to be the case.

    But since some posters are saying Rabbi Kanievsky has urged victims to report abuse to the police in other cases — good news, if true — I must mention that so far Rabbi Kanievsky’s record has not been altogether pure. A concerned party who consulted Rabbi Kanievsky in 2007 told me personally that the rabbi opposed reporting Stefan Colmer, then charged (later convicted) of abusing two boys, while Colmer was still at large in Israel. Rabbi Kanievsky also signed a petition in support of Rabbi Elior Chen, who was later sentenced to 24 years in prison for horribly torturing 8 children. And in 2006, the same Rabbi Kanievsky joined other rabbis in a public decree in support of Yisrael Valis, soon to be convicted of killing his infant son by beating him against a wall. In fact, as recently as 2010, the Lakewood rabbis who publicly attacked the family of the young victim of Yosef Kolko for going to the police claimed, in an open letter (circulated before Kolko’s conviction for child abuse), that Rabbi Kanievsky supported their denunciation of the “informers.” I am not aware that Rabbi Kanievsky has ever publicly repudiated any of these positions, though it has been claimed (by others) that he eventually withdrew his support from Chen.

    People can change, and I would be delighted to learn that Rabbi Kanievsky now opposes obstructions of justice or automatic, enforced support for accused Orthodox child abusers. But at the moment I think the jury is still out on the integrity of his position, particularly given the absence of any public retraction (or denial) of his disturbing record in earlier cases.

  8. Maybe it is time for the rabbis involved in other cases as some posted on this site to give over to the police the knowledge of those cases. For instance the case of Efraim Becker that Rabbi David ostrov and Dr levit and Rabbi Rubin and Rav Moshe shternbuch were informed about.

    • Absolutely. In this case the allegation is that Becker was sexually involved with clients. Just to be clear, some actions involve sexual activity by clergy with adult women with no use or threat of force and might not be prosecutable in the US. In Israel, regardless of consent, a clergyman cannot be sexually involved with a congregant. It is prosecutable, even without any allegation of assault or coercion.

  10. If it is true it is a most horrible despicable act. This perverted roshe mirushe rapist who violated these girls both physically and emotionally he murdered them and stole their lives for his depraved disgustingness he is the worst scum of the earth etc……
    My only question is did anyone but the accusers come forth is there a beis din involved etc…
    If it is only a shmua from the accusers of course it must be investigated thoroughly by a third party/police shin bet etc. But until then how is it permitted to publcize such a terrible thing that has not yet been corroborated?

    • Read the police indictment for which I provided a link in the story. The allegations were brought to rabbonim over a year ago. It took this long to get their approval to go to the police. It is a mitzvah to expose molesters and those who cover up for them. Lo saamod al dam reyachah. There are multiple allegations that he also abused boys in the yeshiva. Every day’s delay in pressing charges endangered kids and may have enlarged the many he hurt so badly. Every delay in full exposing him increases the chance that more his crimes will be covered up and increases the possibility that his protectors will escape justice.

  11. I just discovered your site today, and I’m aghast at how many of these horrible cases there are. How shameful that there are enough such crimes to fill a blog! My naïveté is now shattered.
